Municipal Properties Tree Bylaw

The Municipal Properties Tree bylaw provides regulations for the control and management of trees located on city-owned property. Under the terms of the bylaw no person shall remove, transplant, prune, deface or otherwise injure a tree on city owned property without the written permission of the City of Kelowna Parks Department. The bylaw also requires that no person may plant a tree on city-owned property without first receiving the permission of the Parks Department.

Tree Protection

The Tree Protection bylaw prohibits the removal of a tree in the “Tree Cutting Permit Areas” defined in the bylaw or a Natural Environment/Hazardous Condition Development Permit Area defined in the Official Community Plan, without a permit. The bylaw outlines the permit application procedures and requires that any tree removed under the provisions of this bylaw must be replaced with two trees within one growing season.

Airport Fees Bylaw

The Airport Fees Bylaw sets the fees for use of Kelowna International Airport terminal space and lands. It outlines the fees for aircraft landing, aircraft parking, fuel concession, air terminal building space, and an airport improvement fee charged to departing passengers. It includes the authority for the Airport Director to approve a temporary reduction in aircraft landing fees for inauguration of a new air service.

Electricity Regulation Bylaw

The Electricity Regulation Bylaw sets out the rates charged for use of the City’s electrical distribution system. Provision is made for a sliding scale of rates based on the amount of metered consumption and the type of consumption (commercial, industrial, residential, etc.). The bylaw also sets out regulations concerning the installation, construction, alteration, repairing and maintenance of any electrical works with the electrical service area of the City.

Holding Tank Bylaw

The Holding Tank bylaw provides regulations for the installation of domestic sewage holding tanks within the city. Provisions are made for permit requirements, tank design and installation, disposal of the sewage and the conditions under which a holding tank may be allowed.

Building Bylaw

This bylaw covers the construction, alteration, repair, or demolition of buildings and structures, including swimming pools, within the City. The bylaw sets out the information required to apply for a building permit, the permit fees and the conditions where a building permit may not be required. The bylaw also outlines the powers and duties of the building inspectors and how occupancy permits are issued.
